These Terms & Conditions apply to all services provided by MagicX, including but not limited to our websites, networks, applications, software, mobile applications, and other related services (collectively referred to as the 'Service').

By using the Service, you agree to comply with Malaysian laws, including the Personal Data Protection Act 2010 (PDPA) and the Communications and Multimedia Act 1998 (CMA).

Legal Agreement

These Terms of Service ('Terms') are a legally binding contract between you and MagicX. By using the Service, you agree to the following:

1. You have reviewed and accepted the terms and conditions, as well as MagicX’s Privacy Policy and Cookie Policy, which are incorporated into these Terms.

2. If you do not agree to these Terms or are not eligible to use the Service, you do not have permission to access or use the Service.

Your continued use of the Service constitutes your agreement to be bound by these Terms.

Eligibility

By using the MagicX Services, you affirm that you are at least 18 years old, or if under 18, have the consent of a legal guardian. You are responsible for ensuring compliance with all local laws applicable to you.

User Accounts

To access certain features, you may be required to create an account. You agree to provide accurate information and maintain the security of your account credentials. You are responsible for all activities under your account.

Use of Service

The Service provides a digital workspace for groups to create, plan, and collaborate on marketing content. By using the Service, you agree to the following:

1. You will use the Service only for its intended purposes and in compliance with these Terms and Malaysian laws.

2. MagicX reserves the right to terminate or suspend access to the Service if you violate these Terms or engage in any of the following prohibited actions:

• Misusing the Service for unlawful or fraudulent activities.

• Uploading content that is defamatory, offensive, or violates Malaysian laws under the CMA 1998.

• Attempting to gain unauthorized access to MagicX systems or services.

MagicX may report any illegal activities to the relevant Malaysian authorities

Payment And Fee

Certain features of the MagicX Services may be available for purchase. All fees are due at the time of purchase and are non-refundable unless otherwise stated in the applicable refund policy.

Intellectual Property

MAGICX owns all intellectual property rights in the MagicX Services, including text, graphics, logos, and software. Unauthorized use, reproduction, or distribution of any MAGICX content is strictly prohibited.

Personal Data Protection

MagicX is committed to protecting your personal data in accordance with the PDPA 2010. By using the Service, you consent to the collection, use, and processing of your personal data as outlined in our Privacy Policy.

1. Personal data will not be shared with third parties without your consent, except where required by law or necessary to provide the Service.

Prohibited Activities

3. Engaging in any activity that compromises the security or functionality of the Service.

MagicX reserves the right to restrict or terminate your access to the Service if you are found to engage in any prohibited activities.

Disclaimer Of Warranties

The MagicX Services are provided “as is” and “as available” without warranties of any kind. MagicX disclaims all warranties, express or implied, regarding the operation, accuracy, reliability, or availability of the MagicX Services.

Limitation Of Liability

In no event will MagicX be liable for any damages arising from your use of or inability to use the MAGICX Services, even if MagicX has been advised of the possibility of such damages.

Indemnity

You agree to indemnify and hold harmless MagicX, its affiliates, and its personnel from any claims or liabilities arising from your use of the MAGICX Services or violation of these Terms.

Third-Party Content And Services

MagicX may link to third-party sites or services but does not endorse them. You are responsible for reviewing and complying with third-party terms, as MagicX is not liable for third-party content or services.

Security

You understand and acknowledge that the MagicX Services may contain bugs or be susceptible to breaches. You are responsible for any resulting claims or damages from the unauthorized use of personal data on your device.

Product Purchases And Refunds

Product purchases are governed by local market policies, available on the MagicX website. Providing inaccurate billing information is a violation of these Terms. In case of an incorrect product price, MagicX reserves the right to cancel orders and issue refunds.

Returns

If you wish to return a product purchased via the MagicX Services, please refer to the return policy applicable to your market, available on your local MagicX website.

Promotions

Participation in any contests or promotions hosted by MagicX is subject to additional terms, including eligibility requirements. Promotions are void where prohibited.

Purchase Limitations

MagicX may impose restrictions on product availability, promotions, and descriptions without prior notice. Prices and availability may change at any time.

System Outages

MagicX schedules maintenance downtimes, but unplanned outages may occur. MagicX is not liable for service interruptions or resulting data loss.

Account Access and Troubleshooting

MagicX has the authorization to access the user account if needed for troubleshooting problems. MagicX will not be held liable for any unforeseen circumstances that may arise as a result of accessing the user account.

Risk of Number Blocking and Mitigation Recommendations

MagicX cannot guarantee that the number you are connecting with MagicX will not be blocked by the Official Company. MagicX can only recommend ways to minimize blocked risks, including the following:

1. Connect Instant Messaging numbers that are more than 30 days old or previously used to ensure they move humanely by engaging in actions such as replying to chats, saving contacts, joining groups, sending photos, scanning QR codes on personal desktop Instant Messaging, filling in profile details, and other activities within the Instant Messaging chat application.

2. Avoid sending spam messages, mass messages, or unsolicited blasters that are not desired by the recipient.

3. Obtain informed consent or request permission from the recipient of the message before sending Instant Messaging automatic messages to those who are willing to receive messages via Instant Messaging.

4. Avoid sending more than 500 messages per hour.

5. Avoid sending messages with identical words or sentences to many numbers.

Responsibility for Blocked Numbers

MagicX is not obliged to replace any blocked number.

Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be resolved exclusively in Malaysian courts.

Fees From Service Providers

You agree to pay any fees charged by your wireless or internet service provider in connection with your use of the MagicX Services. MagicX is not liable for any functionality failure resulting from unpaid charges.

Notices

By using the MagicX Services, you consent to receive all agreements, communications, and notices in electronic form, including SMS.

Distribution Channels

MAGICX Services may be available through third-party distribution channels, such as the Apple App Store or Google Play. You agree to comply with any additional terms from these channels when using MagicX apps.

Updates to Terms

MagicX reserves the right to amend these Terms & Conditions at any time. Updated terms will be posted on our website and continued use of the Service indicates acceptance of any changes.

No Waiver

MagicX’s failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Severability

If any part of these Terms is found to be unenforceable, the remainder will remain in full effect.
